Conditions of Sale
1. All horses are sold as is. If you have questions on a horse please ask prior to bidding.
2. This is an internet auction NOT a live auction. Bidding is open now. There are NO auction fees on top of your bid that are charged.
3. We consider your bid to be a commitment of purchase or intent to purchase the horse you bid on. Anyone who does not honor a bid or a win will be banned from future sales.
4. All Bidders must register for a bidder number. Email Lynn for a bidder number.
5. All Bids must be received by email to Lynn@ArabianEcho.com or Lynn Bateman@Cox.net
a) Bids will be posted in the order that they are received.
b) Bids will be posted to the website as quickly as we can get to them. Please refresh your page to see the current bids.
c) If you have emailed a bid and you don't see it reflected on the page within 14 hours please email us to confirm that we have received the initial bid.
d) Only bids with valid bidder numbers will be accepted.
e) Bids will be posted under the appropriate horse. Bidder # and price will be displayed. Refresh for changes.
f) Bids are to be made in 100.00 increments or more. Bids under $100.00 will NOT be accepted.
6. Auction will run through the date and time determined and designated. Ending time is November 30, 2011 at 9 pm EST.
7. Final bid received and time stamped prior to the end of auction will be the bid that is honored, proxy bids taken into consideration at that point.
8. Payment, or payment agreement, is expected within 48 hours following the end of the sale, unless previous arrangements are made with the seller. All bids are considered to be payment in full unless terms are agree upon in writing (via email) BEFORE a bid is placed.
9. Each farm will have their own terms of payment required..(ie: PayPal; personal check, certified check, or money order). Bidder needs to check with Consigner for details.
10. Payment by Paypal or Credit card will incur a 3% fee.
11 Horses may remain at the sales farm for thirty (30) days for no additional charge while transportation is arranged. After that period a daily fee, to be designated by the seller, will be implemented and will be the responsibility of the buyer.
12. The auction sale is "an auction with reserve", that is, the owner shall have the right to establish a reserve, a price under which the horses will not be sold. The reserve in this auction shall be a sealed reserve in which the owner has established the reserve, if any, in writing prior to the offer of each respective horse in the auction.
13. Upon the winning bid, risk of loss and responsibility for the horse shall be upon the buyer.
14. Buyer agrees to hold the seller harmless from all losses, costs and expense, having to do with or rising from illness, injury or death of any animal offered or purchased, and any loss or damage to property and injury to persons, including death, caused by buyer, buyers agents, representatives or employees, or by the animal, following buyers purchase of an animal
15. Notwithstanding, delivery of the horse purchased to buyer, Sales Management will retain all registration papers and transfers until payments have been verified, i.e. checks have cleared buyer’s bank, etc. Upon verification of payment, registration papers, along with properly executed transfer of ownership reports, and any other pertinent documents related to the animal purchased shall be prepared and mailed to the buyer.
16. A current coggins and health papers for Domestic transport (transport within the US) will be provided at Sellers expense. We will provide full cooperation in obtaining International health papers, etc., but they will be done at the expense of the buyer as they are more time consuming and more expensive in most cases.
17. Seller reserves the right to refuse sale to anyone and may add or remove a horse at any time prior to closing of the auction.
18. Buyer agrees to excute Arabian Echo sales agreement upon the winning the animal.
